On April 18, 2023, the Delaware Court of Chancery denied the request of J. Daniel Plants and David H. Mowry for an expedited trial prior to the upcoming special meeting of stockholders of Cutera, Inc. (the Company), scheduled for June 9, 2023. The plaintiffs had requested expedited consideration of their request to reopen the director nomination window for the Companys 2023 annual meeting of stockholders (the Annual Meeting). The action is captioned Plants v. Barrett, C.A. No. 2023-0420-MTZ. On April 19, 2023, the Special Committee of the Companys Board of Directors scheduled the Annual Meeting for July 13, 2023.
